Terms of Service

These Terms of Service ("Terms") govern your access to and use of webcam.xyz (the "Site"), operated by Webcam.XYZ, a Wyoming limited liability company ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Third-party trademarks, service marks, and logos displayed on the Site are the property of their respective owners. Nothing on the Site grants you any license or right to use those marks.

5. Affiliate Disclosure

This Site participates in affiliate programs. When you click certain links on this Site and make a purchase or sign up on a third-party platform, we may receive a commission. This does not affect the price you pay. Our affiliate relationships do not influence our editorial content. We are a participant in the Chaturbate affiliate program.

6. Disclaimer of Warranties

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00 USD).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

8. Indemnification

You agree to defend, indemnify, and hold harmless Webcam.XYZ and its officers, directors, members, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. Accessing third-party sites is at your own risk and subject to those sites' own terms and policies.

10. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. 18 U.S.C. § 2257 Compliance

webcam.xyz is not a producer of any sexually explicit content. All content accessible through this Site is hosted on and produced by third-party platforms. For records required by 18 U.S.C. § 2257 and 28 C.F.R. § 75, please refer to the 2257 Compliance Statement and the custodian of records for the originating platform.

12. DMCA / Copyright Infringement

We respect intellectual property rights. If you believe that content accessible through the Site infringes your copyright, please send a notice to our designated agent containing: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material and its location; (3) your contact information; (4) a statement of good faith belief; (5) a statement of accuracy under penalty of perjury; and (6) your signature.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to personal jurisdiction in those courts.

WAIVER OF CLASS ACTION: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Site after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Site.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and 2257 Compliance Statement, constitute the entire agreement between you and Webcam.XYZ regarding your use of the Site and supersede all prior agreements and understandings.
